What is Clearpat Services, LLC?


Clearpat Services is a Patent Procurement and Technology Commercialization Consulting Service Provider that was established to support small to mid-size businesses and individual inventors in the Austin and central Texas area. In particular, Clearpat Services specializes in supporting mechanical, medical, and biotech device and technology companies with their patent portfolio development.

Since the early 1980s, the founder has been a part of those growing industry in central Texas. He knows the history and the players. He's seen small entrepreneurs who copied their competitors, hoped for the best, and simply managed to survive year after year, while others have grown and/or been acquired.

Only those with great ideas, solid strategies and funding, great management, and strong intellectual property ever "make it". Those that fail to recognize (early on) the need to protect their ideas (their intellectual property/intangible assets), or even fully recognize what their full intellectual property may be, could be missing out on over 50% of the true value in their business.

There is a definite need to provide affordable patent strategic counseling, prosecution and consulting services for those entrepreneurs and start-up companies struggling to make ends meet, faced with these dilemmas:

  • As a budding entrepreneur or start-up venture, can you afford to spend the money for legal advice and patent protection versus building another prototype?

The founder of Clearpat Services has been a part of the central Texas technology boom since 1982, generating patentable technology since 1988, managing patent portfolios since 1999 and a practicing registered U.S. Patent Agent since 2009.






We are not a law firm. Clearpat Services, LLC is a Patent Procurement and Technology Commercialization Consulting Service Provider. The United States Patent and Trademark Office (USPTO) registers both attorneys at law and persons who are not attorneys at law. The former persons are referred to as “patent attorneys”, and the latter persons are referred to as “patent agents.” A Juris Doctorate or a license to practice law is not a requirement to write or prosecute patents. One needs an undergraduate degree in one of the engineering or physical sciences (biology, chemistry, one of the disciplines of engineering, physics, computer science, etc.) Many attorneys have "soft art" degrees such as history or English and are not qualified to be patent attorneys. Only an engineering or physical science degree (or a minimum number of equivalent engineering and science credit hours) qualifies one to sit for the US Patent Bar Examination.

Both patent attorneys and patent agents have passed the US Patent Bar Examination administered by the USPTO. Both patent attorneys and patent agents are permitted to prepare an application for a patent and conduct the prosecution in the USPTO. Patent agents, however, cannot conduct patent litigation in the courts or perform various services which the local jurisdiction considers as practicing law. For example, a patent agent could not draw up a contract relating to a patent, such as a license, if the state in which he/she resides considers drafting contracts as practicing law. In specific cases where these types of legal services are required, Clearpat Services has made arrangements with several local law firms to assist with your specific needs. Pricing for these services is quoted separately by these firms and will be in addition to the cost of services provided by Clearpat Services.

The owner and founder is a Patent Agent, registered to practice before the USPTO. Persons who are not recognized by the USPTO for this practice are not permitted by law to represent inventors before the USPTO. The USPTO maintains a register of attorneys and agents; (http://des.uspto.gov/OEDCI). To be admitted to this register, a person must comply with the regulations prescribed by the Office, which require a showing that the person is of good moral character and of good repute and that he/she has the legal, and scientific and technical qualifications necessary to render applicants for patents a valuable service. Certain of these qualifications must be demonstrated by the passing of the US Patent Bar Examination.
